I think Greg Medcraft, whos been head of Australian Securities and Investments Commission (ASIC) for the last year, has done a good job compared to his predecessors.

Regulators should work cooperatively with the industry to better regulate industries they oversee.

A collaborative approach always works better, and gains the respect of the relevant industries.

Especially when there are so many grey areas in corporations law, unlike criminal law, which is generally black or white.

Because of the many grey areas where laws arent clear, its important industry regulators provide guidelines of what their interpretation of the law is, so companies know what is and isnt compliant. And if one disagrees with ASICs interpretation, theres always mediation, or courts to clarify the law.

Of course if theres blatant criminal activity, a regulator has to send white-collar criminals to jail, to scare people so they dont break black and white laws.

For example: if you rob a bank, you know youre committing a crime.

But you could easily breach a corporations law and be none the wiser.

Because many laws are not clear and only a court can determine if something is or isnt a breach, as both ASIC and the industry dont actually know.

And thats because many laws are untested or actually conflict with other corporations laws.

But in areas where there is uncertainty in relation to the law, regulators need to take a tread softly approach and educate on what they believe to be compliant behaviour, to achieve a fair outcome.

Mr Medcrafts leadership should be commended because it is collaborative approaches like this that encourage better working relationships with industry; and greater investor protection.

This is a far cry from a decade ago when ASIC was using suspect tactics with the courts and would point blank refuse to provide guidelines to industry, simply to increase their chances of capturing companies accidentally breaching uncertain laws to boost its report card.

My battles with ASIC a decade ago gave me great insight into how abuse can occur at the hands of overzealous bureaucrats given too much power.

And how they can often go on relentless non-commercial pursuits to target certain sectors of industry, while neglecting to keep an eye on important, obvious areas.

Like the blatant losses caused by companies such as Storm Financial, which could be seen coming for years before any action was taken.

Or doing the dirty work for industries such as the financial planning body who lobbied to ASIC to wipe out competitors like financial educators a decade ago, using draconian measures that are an abuse of its mandate.

ASIC now seems to be more about doing its job, whereas in the past it was largely about being seen to be doing its job.

It didnt care if someone was innocent or guilty; instead it was all about getting as many convictions as possible, to be seen as doing something.

Heavy-handed, unfair tactics discredit the regulator.

Especially when blatant, illegal activities happened in the market with ASIC failing to take action, which would have stopped billions being lost unnecessarily by investors.

Its good to see ASIC take action against the financial planning industry for their blatant abuse of consumers over the past several decades in their efforts to ban financial planning commissions; and for this they should be commended.

Their efforts to improve financial advertising standards are also a step in the right direction, if they arent overdone.

Ive said before, Financial regulation will only do so much.

Financial education is far more effective at protecting consumers than over regulation.

I mean take a look at things like the size of a prospectus now.

Over regulations have made the fine print expand to so many pages that no one bothers reading them. Which has decreased investor protection.

And its on that note Im proud to say Ill soon be announcing the launch of a brand new industry body for financial educators.

Its been designed to provide free financial education resources, push the importance of financial literacy and the financial education industry, and increase consumer protection within the industry with a free consumer complaints service.

Did you know: Across the ditch an equivalent of ASIC (the FSA) has been started?

However they want Australian financial educators to be licensed in NZ now too.

This is a bad move, one that will prevent NZ consumers from accessing a financial education and leave them at the mercy of the financial planning industry, which caused massive losses to NZ investors in recent years.

So much so that the NZ Government had to fork out $795 million to cover losses.

This is an example of over regulation having the opposite effect than intended.

Most Australian financial educators, who are already licensed in Australia and paying thousands in fees, simply wont invest in a NZ license for such a small domestic market.

We have recently written to the NZ FSA suggesting they consider financial educators licensed by ASIC in Australia be able to speak at events in NZ without having a dual license.

For Kiwis sake I hope so. Otherwise theyll all have to spend more on airfares to access leading edge financial strategies and education over here.

Russians protest against pension reform

On Sunday, reportedly over a thousand Russians were arrested for illegally protesting against government plans for pension age adjustment. The protest spanned several regions across the country. The plan would raise the retirement age an additional five years, with new age for men at 65, for women at 60.

According to monitoring data from media project OVD-Info, 1018 people were arrested, including 452 people in St Petersburg, 183 people in Yekaterinburg, 60 in Krasnodar, 43 each in Moscow and Omsk, 23 in Perm, 22 in Kazan, 20 in Tver, 17 in Ufa, 15 in Habarovsk, 13 each in Tomsk and Belgorod, 12 each in Chelyabinsk and Lipetsk, 10 in Novosibirsk, and some 80 in other cities.

In Moscow, the rally started at Pushkin Square at 2 p.m. local time and anti-riot police pushed people away. They marched toward the Kremlin. On their way, they again clashed with Police and did not complete the route.

The protests reportedly started in the Far East and Siberia first, followed by western regions of the country.

Regional elections were also on Sunday.

The pension adjustment plan has reportedly coincided with a significant drop in approval rating of Russian President Vladimir Putin.

Ex-cosmonaut Konstantin Feoktistov dies; Soviet space pioneer was 83

Pioneering Soviet cosmonaut Konstantin Feoktistov has died aged 83. A statement by the Russian Space Agency declared that he died of “unspecified causes” last Saturday in Moscow.

Feoktistov was important in the early development of Soviet space travel and was part of the first group spaceflight in history, as part of the Voskhod 1 mission in 1964. He was also the first civilian allowed to participate in the Soviet space programme.

He was born in Voronezh in 1926 and was wounded whilst serving in WWII. His inclusion in the spaceflight programme was often met by resistance from the Soviet government as he was neither a member of the communist party or in the military at the time. After his retirement from space travel he continued to work as a designer and engineer for the space programme until 1990, helping to design spacecraft and space stations such as Mir and Soyuz, amongst others.

Buffalo, New York —In an unanimous vote, the City of Buffalo‘s Planning Board voted to table the Elmwood Village hotel Proposal, postponing voting on legislation for up to 30 days.

The Board said its decision was due to the lack of public involvement, saying that there have not been enough meetings.

The Elmwood Village Hotel is a proposed project by Savarino Construction Services Corporation and was designed by Karl Frizlen of The Frizlen Group. The hotel would be placed on Elmwood and Forest Avenues in Buffalo, New York. In order for the hotel to be built, at least five buildings, that include both businesses and residents, must be demolished.

The Forever Elmwood Corp. is a Buffalo-based non-profit organization founded in 1994. Justin Azzarella, the Executive Director for the organization voiced support for the proposal, stating: “I am here today to lend Forever Elmwood’s support the hotel project. Particularly, Forever Elmwood is encouraged by the fact that this building follows the more stringent Elmwood Village Design Guidelines. We have been speaking with Savarino Construction, and they have promised us [Forever Elmwood] that they will engage the community further, including the surrounding Block Clubs and businesses. For that reason, while Forever Elmwood is in support of this project and the type of project that it is, we are asking also that the project be tabled so that the community can be further engaged. Specifically the surrounding Block clubs which include the Granger, Claremont, Asland and The Lincoln Parkway Block Clubs.”

“Because of the excellent work that Karl does and the game plan that they have, I think its an ideal use of this particular location. I think that this particular type of development needs to be encouraged and promoted as opposed to roadblocked,” said a man who owns five properties near the proposal site.

However, Evelyn Bencinich, a resident of Granger Place and whose house would be located directly behind the hotel said, “My property value will be depreciated or non-existent because no one is going to want to live behind a multi-story hotel. We are facing up to a year of noisy and dangerous demolition and construction. Children, pets and even drunk rebellers could wander on site and get hurt. Traffic tie-ups caused by large machinery and garbage bins is inevitable. Where will pedestrians walk? We could experience increased unsanitary flooding in our yards and basements due to the digging and cementing for the underground parking garage. Rats will be displaced into the immediate neighborhoods and be in great abundance. Once we get past the year of nightmare construction, what if you build it and they don’t come? We could ultimately have a seven million dollar rooming house on our corner.”

Patty Morris, co-owner of Don Apparel with Nancy Pollina at 1119 Elmwood also asked that the project be tabled saying, “this has only been public knowledge for less than two weeks and the public never saw the redesign. How can you vote on anything that no one has seen yet? The Board cut off Morris saying, “so specifically you don’t have any problem with it [the design] you just…” Morris then said, “Oh I am totally against this project, but thats besides the point isn’t it.”

The planning board is also concerned that the current design may still be too big.

At one point Board member Susan Curran Hoyt said, “we know you’ve cut down your number of rooms on this project, but we still see it doesn’t seem to fit the description of a ‘botique’ hotel,” and asked Eva Hassett, Vice President of Savarino Construction, “we wonder if you could reduce the rooms further.”

“One thing I didn’t talk about was the price levels of these rooms and that will be important to know. The room rate will be somewhere between US$120 and $160 a night, which is about the same price of the Hampton Inn down town and the smaller you make the hotel, the more expensive the rooms will get. We believe that we’ve made a good compromise in terms of the size of the hotel and perhaps botique means different things to different people,” said Hassett.

The board was also concerned that there is not enough parking asking, “are there alternative plans for valet parking off-site, in the event that you have a full hotel or a large event going on?”

“We are exploring several possibilities with respect to additional parking for valet and parking near-by,” replied Hassett. “We are also exploring the possibility of using the rear of 1105 Elmwood for additional parking, which would give us an additional ten or eleven spaces.”

The new design has a total of 55 parking spaces for 72 rooms, with 39 of them underground and the rest on ground level.

Hassett also said that a “parking study” will be done on the area.

Concerns that the second floor of the hotel will be too close to the property of 605 Forest were also brought up. The board asked how far the hotel would be from the property and Karl Frizlen replied saying it would “be approximately five feet from the property line,” but he also admitted that, “I do not know exactly how close the house next door” will be from the hotel, but did say “I think the house is about four or five feet away from the property line and we [the hotel] sit right on the property line.”

The board is concerned the setback from the property is not enough saying the space between the building and the hotel is “pretty narrow.”

The City’s Common Council also agreed to table the proposal also citing the need for more public engagement and the need for more organizations to respond including the Buffalo Preservation Board and the Office of Historic Preservation.

During that meeting, Hassett also said the proposal to try and get a variance to obtain the properties of 605 and 607 Forest were “now off the agenda.”

The Common Council is expected to meet and hold a public hearing about the project and the rezoning of the properties to be demolished (1119-1121 Elmwood) on Tuesday March 7, 2006 at 2:00 p.m. in Council Chambers at City Hall. At the moment the properties are not zoned for a hotel.

NASA plans for future moon missions

NASA has announced plans for sending humans back to the Moon, as a first step to Mars.

A 2018 lunar mission is proposed, where a crew of four would remain on the Moon for as long as a week. A minimum of two lunar missions a year is planned, with astronauts remaining as long as six months.

Some of the technology had previously been proposed for replacement of the Space Shuttle.

  • Astronauts will be launched in a capsule, similar in concept to that used for the Project Apollo but three times larger. The top part of an Exploration Transportation System (ETS), the Crew Exploration Vehicle (CEV) will be a capsule attached to a service module which contains supplies, power, and propulsion units. The CEV is designed for use in Earth orbit.
  • On lunar missions, crew or cargo versions of a Lunar Surface Access Module (LSAM) would be used with a CEV. The LSAM will have design concepts related to the Apollo Lunar Module, with a four-legged landing unit carrying an ascent stage.
  • An Earth Departure Stage (EDS), a powerful propulsion unit, will be used to move CEV and LSAM units out of Earth orbit, such as on lunar missions.
  • Heavy Launcher unmanned cargo rockets will be used for heavy loads of equipment.
  • The launch rockets, Shuttle Derived Launch Vehicles, will use engines developed for the Shuttle program.
    • CEV will be launched atop a Crew Launch Vehicle (CLV), a single solid fuel booster with a second stage using a shuttle main engine. The CLV can carry a payload of 25 metric tons into low Earth orbit.
    • The heavy-lift system uses a pair of longer solid rocket boosters and five shuttle main engines to put up to 125 metric tons in orbit — about one and a half times the weight of a shuttle orbiter.
  • The use of a Launch Escape System (LES) will improve safety. A LES is a top-mounted rocket that can quickly remove the crew capsule away from an exploding or otherwise dangerous rocket.

For a lunar mission, the LSAM and EDS would be placed in orbit by a cargo launcher, then a CEV would dock with the assembly before leaving Earth orbit.

The goal is to begin production of the new spacecraft by 2011.

  • Robotic missions will be sent, probably the first one in 2008.
  • Past experience with lunar dust is being used in designing equipment and spacesuits which may encounter it.
  • Surface mobility with open and pressurized rovers for use in such missions is also being developed.
  • The CEV can be reused up to ten times.
  • Crew capsule, upon return to Earth, will set down on dry land. It can also land on water.
  • The CEV and lunar lander ascent stage use methane as fuel, as methane may be available on Mars.
  • Eventually the designs could be expanded to support six astronauts for a trip to Mars.

The plans are a means to implement President Bush’s “Vision for Space Exploration” program. Goals include:

  • Implement a sustained and affordable human and robotic program to explore the solar system and beyond;
  • Extend human presence across the solar system, starting with a human return to the Moon by the year 2020, in preparation for human exploration of Mars and other destinations;
  • Develop the innovative technologies, knowledge, and infrastructures both to explore and to support decisions about the destinations for human exploration; and
  • Promote international and commercial participation in exploration to further U.S. scientific, security, and economic interests.

Three nations in three continents have seen attention focused on high suicide rates this week. A study found Scotland’s suicide rate to be increasing away from neighbouring England, Russian press and politicians are examining the world’s third-highest teen suicide rate, and new figures showed increasing Aboriginal children’s suicides in Australia’s Northern Territory.

“Until the highest authorities see suicide as a problem, our joint efforts will be unlikely to yield any results,” Boris Polozhy of Moscow’s Serbsky psychiatric center said yesterday. Only fellow ex-USSR nations Belarus and Kazakhstan have higher teen suicide rates than Russia, which is at around 20 per 100,000 nationally. Tuva, Siberia and nearby Buryatiya have rates of 120 and 77 per 100,000 respectively. Thursday saw national children’s ombudsman Pavel Astakhov say 4,000 youths kill themselves each year.

Top Health Ministry psychologist Zurab Kekelidze yesterday responded to expert calls for action, promising to “very soon… start implementing” a plan of action to tackle the issue. He said Russian schools, which are criticised for understaffing and perceived inattention to bullying, should teach psychology.

Kekelidze asked the Russian Orthodox Church to help the suicidal, and severely criticised popular online forums dedicated to suicide, where methods are compared. “I have seen websites that offer a thousand ways of killing oneself,” he claimed. Astakhov wanted schools to offer assistance via a social networking presence and tackle online bullying.

The overall national suicide rate is decreasing — down from 42 per 100,000 in 1995 to 23.5 two years ago. The high rate amongst teens is attributed to both school problems and violence at home. Recent high-profile cases include yesterday’s death of a twelve-year-old who hung himself at home in Krasnoyarsk, Siberia, and two fourteen-year-olds who jumped hand-in-hand to their ends from a building in Lobnya, Moscow.

Researchers from the Scottish cities of Edinburgh and Glasgow, and Manchester in England, have been looking at data from 1960 to 2008. Although Scotland had the lower rate until 1968, England and Wales has had the lower rate since. Both areas had increasing rates until the southern side started to fall in the ’90s, and in recent years the gap has significantly increased.

Data was sorted by age, gender, and method; marked increases were seen among Scotsmen aged from 25 to 54 with hanging increasing in popularity. The female rate has remained largely static.

“This study adds to our understanding about patterns of suicide in Great Britain by producing sound evidence on divergences in long-term trends in Scotland compared to England and Wales,” said Professor Stephen Platt, a lead researcher from Edinburgh University’s Centre for Population Health Sciences. “In a future companion paper we will suggest explanations for the persisting higher rate of suicide in Scotland.”

Fellow joint lead researcher Roger Webb of the Centre for Suicide Prevention of Manchester University said the high Scottish hanging rate was “of particular concern as hanging has high case-fatality and is difficult to prevent, except within institutional settings.” He noted “a public information campaign about hanging” could be one way of reducing the rate. Paid for by the Scottish taxpayer, the results appeared in the British Journal of Psychiatry.

In an incident with parallels to the recent Moscow deaths, in 2009 Scottish and British media publicised a high-profile case in which two teenagers leap together from the Erskine Bridge, a famed suicide spot over the River Clyde where an estimated fifteen people kill themselves each year.

This week also saw Howard Bath, Children’s Commissioner for Australia’s Northern Territory, suggest the area had the highest proportion of Aborignal girl suicides in the West. There has been a significant increase since an emergency intervention five years ago in response to a report titled Little Children are Sacred which documented widespread sexual abuse of Northern Territory children and failures by authorities to adequately respond.

A national government-backed Northern Territory suicide inquiry is ongoing and due to report next month. The inquiry has heard clusters of deaths occurred around East and West Arnhem, Katherine, and the vicinity of Alice Springs. The Tiwi Islands had a very high rate from 2000 to 2005, but has now not had a suicide for a year.

Female suicide rates have greatly increased to account for 40% of Northern Territory suicides amongst those aged less than eighteen. “We now have a situation in the territory where there are almost as many female as male suicides,” said Bath. Lack of information is a problem; the all-party inquiry has heard evidence of much under-reporting and poor data collection. The Menzies School of Health’s Gary Robinson called for a Queensland-style register of suicides.

Robinson suggests cannabis-induced psychosis to be a contributing factor but laments “The big problem is nobody keeps any data. Everything is based on impressions.” He also suggested bullying, as in Russia, is a problem while Bath notes violence against women may also take a role. “Aboriginal women are being hospitalised for assault at 80 times the rate of other women… Exposure to violence greatly increases the risk of a person taking their life.” He also notes “I am concerned, as the commissioner, about children who are frequently exposed to violence in the home or in the immediate family.”

As with Scotland, hanging is a popular choice. “The method chosen is usually hanging and it is a particularly lethal method, far more than an overdose,” said Bath. New South Wales, with the nation’s largest indigenous population, has a suicide rate of one per 100,000 but the Northern Territory rate is over 30 per 100,000.

Acting teacher and director Milton Katselas died Friday at age 75, after suffering from heart failure at Cedars-Sinai Medical Center in Los Angeles, California. He began the Beverly Hills Playhouse in 1978 and taught acting classes there to noted actors including George Clooney and Gene Hackman. Katselas is survived by a sister and two brothers.

Katselas directed an off-Broadway production of Edward Albee‘s The Zoo Story, and received a Tony Award nomination for his 1969 direction of Butterflies are Free. Actress Blythe Danner won a Tony Award for her role in Butterflies are Free under Katselas’ direction. He moved to California to direct the film version of that play, and went on to direct films and television movies. Actress Eileen Heckart received an Academy Award for her role in the film version of Butterflies are Free.

Katselas directed the San Francisco and Los Angeles productions of the play P.S. Your Cat Is Dead! by playwright James Kirkwood, Jr. In his author’s notes in the publication of the script, Kirkwood acknowledged Katselas, and wrote that the plays were “directed with incredible energy and enthusiasm by Milton Katselas, to whom I am extremely indebted”.

Katselas directed the television movie Strangers: Story of a Mother and Daughter, and actress Bette Davis received an Emmy Award for her role in the movie. Katselas taught many famous actors including Michelle Pfeiffer, Richard Gere, Robert Duvall, Jack Lemmon, Al Pacino, Goldie Hawn, Christopher Walken, Burt Reynolds, George C. Scott, Elizabeth Taylor, Richard Burton, Alec Baldwin, and Patrick Swayze. Katselas was credited with being able to nurture actors with raw talent so that they could develop strong Hollywood careers. He utilized innovative techniques in his courses – one course called “Terrorist Theatre” had a simple premise: successfully get an acting role within six weeks or leave the course.

He grew up in Pittsburgh, Pennsylvania to parents who had immigrated from Greece, and graduated from Carnegie Mellon. He studied acting with Lee Strasberg in New York at the Actors Studio, and received advice from directors Joshua Logan and Elia Kazan.

Katselas was a prominent Scientologist, and a July 2007 profile on Katselas in The New York Times Magazine observed that some of his students stopped taking courses at the Beverly Hills Playhouse because they felt they had been pressured to join the Church of Scientology. According to the article, Katselas credited Scientology founder L. Ron Hubbard “for much of his success in life”, and one of his students works at Scientology’s Celebrity Centre. The article commented that some in Los Angeles view the Beverly Hills Playhouse as “a recruitment center for Scientology”.

Katselas met L. Ron Hubbard after moving to California, and began studying Scientology in 1965. The New York Times Magazine reported that he had reached the level of “Operating Thetan, Level 5, or O.T. V.” in 2007. According to The New York Times Magazine when Scientologists proceed up the “The Bridge to Total Freedom” they learn the story of Xenu, and that: “75 million years ago the evil alien Xenu solved galactic overpopulation by dumping 13.5 trillion beings in volcanoes on Earth, where they were vaporized, scattering their souls.” A Church of Scientology publication, Source, lists Katselas as reaching O.T. V. in 1989.

Though some actors felt pressured to join the Church of Scientology after taking courses at the Beverly Hills Playhouse, at least one individual felt Katselas was not active enough with the organization. Actress Jenna Elfman left the Beverly Hills Playhouse because she felt Katselas was not committed enough to Scientology. Katselas had previously directed Elfman in half of Visions and Lovers: Variations on a Theme, two one-act plays about relationships that he had written himself. In 1999 Katselas had planned to adapt the script of Visions and Lovers to a film version, and Elfman was set to reprise her role from the play. In an article in Variety about the project, Elfman commented on her experience working with Katselas: “He is brilliant, and knows me so well as a person and an actress that he gets the most out of me.”

Other prominent Scientologist actors who have studied under Katselas include Giovanni Ribisi, Jason Lee, and Leah Remini. According to Rolling Stone, Katselas also recruited actress Kelly Preston to Scientology. Actress Nancy Cartwright (the voice of Bart Simpson), told Scientology publication Celebrity that Katselas motivated her to get more active in Scientology, and she stated she took the organization’s “Purification Rundown” and her life “took off completely”.

Anne Archer was introduced to Scientology while studying at the Beverly Hills Playhouse, as was former Scientologist and now outspoken critic actor Jason Beghe. Beghe told Roger Friedman of FOX News in April 2008 that “He [Katselas] gets kickbacks”, and that he was brought to a Scientology center by fellow Beverly Hills Playhouse classmate Bodhi Elfman, Jenna Elfman’s husband. In a 1998 article for Buzz Magazine, Randye Hoder wrote “In his class, Katselas is careful not to label anything as a tenet of Scientology, but there is no question that the church’s influence seeps into the playhouse.”

Anne Archer’s husband and fellow Scientologist, producer Terry Jastrow, commented to The New York Times Magazine that Katselas changed the way he experiences life on a day-to-day basis: “I go out in the world and look at human behavior now. I see a woman or man interacting with a saleslady, and I see the artistry in it. Life is an endless unspooling of art, of acting, of painting, of architecture. And where did I learn that? From Milton.”

Actor Anthony Head of Buffy the Vampire Slayer spoke highly of Katselas in a 2002 interview with San Francisco Chronicle: “He’s this wonderfully intuitive teacher and his premise is basically: The only real barriers are the ones we put in front of ourselves. If you say, ‘My character wouldn’t do that’ — bollocks! Ultimately it’s you who wouldn’t say that. Who knows what your character might do.” In the acknowledgements of her 2004 autobiography Are You Hungry, Dear?: Life, Laughs, and Lasagna, actress Doris Roberts wrote: “I thank my friend and acting teacher, the incredible Milton Katselas, for his insights, wisdom, and inspiration, which have helped make me the actress that I am.”

Katselas authored two books: Dreams Into Action: Getting What You Want, first published in 1996 by Dove Books, and Acting Class: Take a Seat, which came out earlier this month. Dreams Into Action, a New York Times Bestseller, sought to modify motivational acting exercises to the field of business.

In an interview in the 2007 book Acting Teachers of America, Katselas commented on his experiences as an acting teacher over the years: “I have very special teachers here at the Beverly Hills Playhouse—some have been with me for over twenty-five years. I believe that to make a difference over the long haul, we need to train teachers. I really care about the craft of acting. It’s absolutely necessary to take the time and patience to really develop an actor.”

Anthony Kristovich III Orthopedic surgeons frequently perform spinal orthopedic procedures to relieve symptoms caused by spinal nerve compression. Nerves that exit the spinal column between the vertebrae can be compressed by an intervetebral disc, by the vertebrae themselves or by bony spurs that have grown next to the nerve. When the nerves are compressed, you have sensory symptomspain, numbness or tinglingand/or motor symptomsweakness or loss of bladder or bowel control. Spinal orthopedic procedures relieve the pressure on the spinal nerve.

Surgical Procedures

Until recently, the only spinal orthopedic procedures available were surgical, and surgery is still frequently performed. The lumbar and cervical spine (low back and neck) are most prone to injury, and most surgeries are performed in those areas. The thoracic spine is more stable, but surgery may be necessary to correct deformities such as scoliosis or kyphosis. Laminectomy/discectomy and spinal fusion are the most common spinal orthopedic procedures performed.

Laminectomy/discectomy involves removing the portions of the disc and bony parts of the vertebrae that are compressing the nerve. The surgeon removes extraneous material and enlarges the opening to relieve the pressure on the nerve. If the disc is badly damaged, it may be replaced with an artificial one.

If the vertebrae are unstable or misaligned and they could re-compress the nerve, the spine is fused, using bone grafts from other parts of the body or rods and hardware. Spinal fusion immobilizes that portion of the spine so that it cannot compress or injure the nerve.

These procedures are usually done as open surgical procedures. The surgeon may approach the spine from the front of your body (anterior procedure) through your abdomen, or he may operate on the back of your body (posterior procedure). In either case, an incision is made in the skin and the muscles and surrounding tissue must be cut in order to reach the spine. That means time in the hospital and a lengthy recuperation afterward, plus the risk of infection or complication.

Minimally Invasive Procedures

In some instances, new minimally invasive spinal orthopedic procedures can be done instead of open surgery. Instead of cutting through the muscle and exposing the spine, a trained surgeon can use a thin, flexible tube with a microscope camera attached to it. This requires only a tiny incision in the back, and the muscle fibers are pushed aside instead of being cut. The surgeon can run laser or surgical instruments down the tube and remove excess tissue to open up the area around the nerve.

Minimally invasive procedures, when they can be used, are safer and sometimes more effective than traditional spinal orthopedic procedures. You don’t have to be admitted to the hospital and are usually back to most of your normal activities within a few days.

Minimally invasive procedures are a wonderful option for some people, but they are not always the best choice. Your orthopedic surgeon is the best person to determine which spinal orthopedic procedure is right for you.
