State schools chief to appeal California High School Exit Exam ban to state high court

State schools Superintendent Jack O’Connell has his lawyers working “around the clock” to prepare to ask the State Supreme Court to overturn a lower court judge’s ban on using the California State High School Exit Exam as a graduation requirement, he said today.

“In an effort to seek resolution of this issue as quickly as possible, I have asked my attorneys to appeal directly to the California Supreme Court,” said O’Connell in a prepared statement, “They are working around the clock to prepare those papers, and we expect to file within 24 to 30 hours. This is a remarkably fast turnaround for an appeal of a ruling that was made less than a week ago.”

Most appeals of a Superior Court decision go to an appellate court first.

Last Friday, Alameda County Superior Court judge Robert Freedman ruled against maintaining the California High School Exit Exam as a condition of graduation for the class of 2006, saying that the law requiring high school students to pass the test is unconstitutional because economically and racially disadvantaged students weren’t offered equal educations and therefore didn’t have an equal chance to pass.

In his statement, O’Connell acknowledged that some students need more help than others, but said the test should stand, anyway: “We know that some students at some schools need extra attention to overcome challenges brought to the classroom and challenges within the schools they attend. We agree those students must have every option available to them to learn the skills on the exam. But I strongly disagree that the remedy for students still struggling to pass the exam is to simply hand them a diploma whether or not they have learned what they need to know.”

Arturo J. Gonzalez, the San Francisco attorney who persuaded Freedman to stop the use of the test, told reporters that Freedman had ruled correctly and that the state should give up and let the students graduate. “There is no basis for the Supreme Court to take diplomas away from 45,000 students who have passed all required courses,” he said in an email exchange with the James Logan Courier. “To do that, they would have to find that Judge Freedman abused his discretion. Given the overwhelming evidence in support of his ruling, I do not think that any of the seven justices will find an abuse of discretion.”

California Governor Arnold Schwarzenegger said he supported O’Connell’s bid to reinstate the test and would “put the full weight of my administration behind reinstating the California High School Exit Exam graduation requirement.”

O’Connell, who wrote the law, wants the requirement to be enforced against this year’s would-be graduates who haven’t yet passed the test and so is set to ask the State Supreme Court to immediately stay Freedman’s injunction to allow the state to withhold high school diplomas as originally planned.. At last count, the ruling affects about 47,000 California Seniors, including about 70 from James Logan High School.

“The decision came as more than 1,100 California high schools prepare for graduation ceremonies,” he said, “It created confusion and uncertainty not only for seniors in the class of 2006 but for juniors in the class of 2007.”

Cynthia O’Brien, who oversees testing at James Logan High School, told The Courier she wants the confusion to end. “If the Exit Exam is going to go forward, then it needs to go forward. If not, then it needs to be cancelled completely,” she said last week.

“Many students now wonder whether they should enroll in summer school or plan to take a summer administration of the exit exam,” he said, “Administrators and teachers are left wondering whether students who need the extra assistance will bother to enroll. And students who should be buckling down to learn the skills they need to succeed in college or the workplace have now been told they can get a diploma whether or not they have those skills.

“It is our responsibility to all of California’s children, especially our disadvantaged and minority students, to equip them with the most basic skills they will need in college, in work and in life,” said Schwarzenegger. “ Postponing the exam graduation requirement will hurt our children in the long run by depriving us of the best tool we have to measure how well schools are doing their job.”

He said he’s budgeted more money to help students pass the test: “My 2006-07 budget will add $7.7 million for three additional administration of the exam and we will also provide $65 million this year to give students at risk of failing the exam the support they need to pass it.”

The high court has 90 days to decide whether to hear O’Connell’s appeal once it’s filed, but could act more quickly if it chooses.

Online Learning

Online learning is fast becoming the preferred way to train or further your education. It’s a far easier way giving the student the ability to learn at their own pace at a time that suits them. Geographical location is no longer a deciding factor in training and neither is having to give up a night out because you have to go to college.

More and more businesses are now turning to Learning Management Systems on the internet as a way of developing and delivering training courses to their staff. Not only is it a way of cutting the costs of training, it also makes it easier for the staff to train at their convenience, rather than having to attend courses away from work.

It’s not just businesses that use this form of training though. More and more people are looking to further their education or train in a different area and, up until now have not been able to. This is mainly due to the cost of having to take time off work to attend courses, give up personal time or that the courses are simply not available in their area.

This is a thing of the past with online learning. There are quite literally millions of different training courses on the internet now and distance learning is fast becoming the way to get hold of the education people require. Training is instantaneous, delivered at a time to suit and at a pace to suit. And it is a far more cost effective method, both for the students and the instructors.

Online learning can be free as well. Many small web businesses use free video training as a way of drawing people to their websites. Everybody loves a freebie and the amount of people who actually sign up to membership of a website that has offered free online learning is quite substantial. Everybody gets something out of the deal and if you don’t, it hasn’t cost you bean.

Setting up your business to deliver online learning can be expensive. However, the savings that can be made by developing and delivering training in this way are quite substantial and everybody benefits from it. Systems are available on the internet to help you set up your training courses and price very much depends on the type of training you want to deliver and the level of support you require.

The old adage “you have to spend money to make money” is quite true in this case and it works both for businesses who will save money in the long run and for individual online learners who could end up landing the job of their dreams simply because they have taken the time to spend a bit of money on their education.

Online learning is not just the future of training; it’s the here and now and is fast becoming the most preferred method of learning. Anybody who does not jump on the bandwagon now is liable to see themselves being left far behind in a technological age.

2008 III IDEAS Show to showcase achievements of Internet industry in Taiwan

To showcase achievements of Taiwan’s Internet industry, the Institute of Information Industry of Taiwan (III) held the 2008 IDEAS Show this Wednesday June 25. The IDEAS Show is similar from the DEMO, an Internet investment trade show in United States since 2006.

The IDEAS show is not just an industry show but an investment demonstration from the Internet industry, we [the III] hope more talents can be developed and discovered in this Web 2.0 era in conjunction with innovation economy.

Chris Shipley, Producer of DEMO Conference, was invited to make a speech in the opening keynote. She mentioned about evolutions and transformations of the Internet, especially on business models and change of leaders. Her words mostly echoed some theories proposed during the 2008 Google Developer Day in China by Kai-Fu Lee, Founding Chairman of Google China.

In this exhibition, thirty websites from mobile networking, Web 2.0, social networks, application services, and hardware integrations were showcased there. The website evaluation from professional judges was also held during the showcase to encourage excellent websites promoted into the world.

UN report: climate change and food shortage major problems for Earth’s future

The United Nations Environment Programme (UNEP) has released a comprehensive report on the current state of the global environment. Climate change, food and water shortage and a decline in biodiversity threaten humanity’s survival, so urgent action is necessary, the report warns.

UNEP’s Global Environment Outlook: environment for development (GEO-4) report involved the work of about 390 experts in various fields from around the world.

The death toll from the weekend suspension bridge collapse on the Indonesian island of Borneo has risen from four to eleven. Search and rescue teams continue to look for bodies in the Mahakam River.

The number of wounded is currently 39 injured; reports from locals suggest 33 people remain missing at the scene in East Kalimantan’s Kutai Kartanegara district, where “Kalimantan’s Golden Gate Bridge” linked the towns of Tenggarong and the regional capital, Samarinda. A six-month-old baby is among the dead.

Cars, motorbikes, and buses all fell into the Mahakam River when the bridge came down during repairs. Another car was left overturned and balanced upon wreckage over the water. State-owned builders PT Hutama Karya completed the bridge about a decade ago in the image of California’s Golden Gate Bridge. A cable on the 720-metre structure is thought to have failed as workers dealt with it; six of the repair crew were reported missing yesterday. It had been the longest suspension bridge in Borneo.

Eyewitnesses described heavy traffic at the time of the collapse, and one survivor said he left his truck to investigate a traffic jam. Some people were left trapped by debris as the bridge came down. “It happened so fast, only about 30 seconds,” according to National Disaster Management Agency spokesman Sutopo Nugoroho.

National search and rescue head Daryatmo said yesterday cranes will attempt to move debris today, with new reports saying echo-sounding equipment will be used to check it is safe to begin lifting. It is believed the bodies of more victims will be found trapped in vehicles beneath the water, which is 35-40 metres deep. Visibility is poor, and one official explained authorities are still unsure how many vehicles are on the riverbed.

“The above-water search is continuing, but underwater operations have not been carried out because we’re worried that the bridge’s pylons are unstable and could collapse any time,” said Nugoroho today. He explained that bodies had washed onto the riverbanks overnight and were recovered today.

The president, Susilo Bambang Yudhoyono, has sent three ministers to the site to investigate the accident, while Bambang Widaryatmo, head of East Kalimantan’s police, promised “parties found to be negligent will be prosecuted”. The government has promised a replacement ferry service. The river is closed to boats as rescue operations continue, and a 22-strong team has been dispatched from the national police, comprising six forensics experts, five disaster victim identification specialists, and eleven investigators. They are there to augment the East Kalimantan Police. Health Minister Endang Rahayu Sedyaningsih yesterday visited survivors in Parikesit Hospital and promised them medical treatment at government expense.

Some people swam ashore after falling, with the aftermath filled with screams. Survivor Syakrani, 24, yesterday asserted “The authorities should have closed the bridge if it was under repair.” His words were followed by a Jakarta Globe editorial declaring the accident “unacceptable”.

The Globe went on to comment upon suggestions corruption may have played a role; “It is too early to point fingers and look to place blame, but if shoddy materials were used in the building of the bridge, those responsible must answer to the public.” Another suggestion is coal barges striking the bridge may have weakened it. Local coal company Harum Energy lost five percent of its share value today amid fears the river blockage will hamper their ability to ship coal.

Samarinda’s seen a population and construction boom lately. A few years have seen the population triple and the construction of a large mosque, and a sports stadium; an airport and port are set to follow. However, the Corruption Eradication Commission warns 70% of the corruption it investigates concerns government contracts and up to 40% of money earmarked for infrastructure ends up stolen.

Israeli media is reporting that Prime Minister Ariel Sharon opened his eyes for the first time since he suffered a major stroke on January 4, 2006.

However, hospital officials said the reports were generated by the Sharon family’s “impression of eyelid movement, whose medical significance is unclear.”

“He was listening to a tape of his grandson and you could see tears in his eyes for a matter of seconds before he closed them again,” a doctor treating Sharon told AFP news agency on condition of anonymity.

Army Radio, citing unidentified close associates of Sharon, say the Prime Minister could “recognize people around him.”

However, hospital officials state that it is “too early to tell whether the development represented a significant improvement or was just a temporary reflex.”

Sharon had undergone a tracheotomy on Sunday to help with his breathing and to help prevent infection from his respirator tube.
